Motor Vehicle Bill of Sale Form - Delaware

What Is a Delaware Vehicle Bill of Sale?

The Delaware Vehicle Bill of Sale is a legally binding agreement that documents the terms and details of a vehicle transfer.

Alternate Name:

  • Delaware Car Bill of Sale

The form can be created for any type of vehicle. It usually includes:

  1. Information about the seller and the buyer: their names, physical addresses, and driver's license number;
  2. Details of the transferred vehicle. The necessary information is as follows: make, model, color, year, vehicle identification number, and odometer readings. In this section, the seller often indicates if the title will be included in the sale;
  3. Important details of the transfer. This part usually specifies the price of the car and the date of the transfer. If the deal includes any special conditions (e.g., the full price is paid in several transactions, the car is given as a gift, or any other), all of the details should be described in this section as well;
  4. Signatures. Both the buyer and the seller must sign the Bill of Sale.

Delaware does not provide a government-issued form for you to use as a Bill of Sale. You may fill out any basic template while following the state requirements. How to Sell a Car in Delaware?

The state does not require you to fill out the Delaware Bill of Sale for a vehicle when you sell or buy a vehicle. However, you are strongly advised to complete one during a car transfer. Finishing a transfer without a copy of your Bill of Sale makes you vulnerable to different legal issues that may arise in the future. This document is useful for both the buyer and the seller as it often summarizes all of the important information you will need to provide during the title transfer.

The seller uses the details from this document to fill out the registration card and the Seller's Report of Sale required by the Delaware Division of Motor Vehicles. The buyers may need the information from the Bill of Sale when completing the Purchaser's Application and the Lien Section.

If a seller from Delaware sells a vehicle with the expired registration to an out-of-state buyer, the buyer may use a Delaware Vehicle Bill of Sale (instead of a certificate of title) as the valid proof of purchase required to claim the temporary tag. This tag will allow the buyer to drive the car to a state where it will be titled.

Does a Vehicle Bill of Sale Have to Be Notarized in Delaware?

The state of Delaware does not require a notary public certification for this document, but you may add one for additional protection in order to confirm that the transaction has taken place. This can save any potential trouble which might occur should the seller or buyer contest the transaction at a later date.
