Do You Need a Bill of Sale in Delaware?

The State of Delaware does not require a bill of sale when selling or buying personal property in the state nor does the state offer you any government-issued form for this purpose.

Though not required officially, you are still recommended to complete the bill of sale when purchasing or selling any personal property in Delaware. When properly completed, this document is equally important for both the seller and the buyer. It serves as proof of purchase and usually contains the important details of the deal. The buyers can use the document to prove they are legal owners of the described item. It may also be applied as a purchase receipt that specifies the date the item was bought and the price paid for it. The sellers typically use the bill of sale to release themselves from any responsibility for the described property. They often add the close stating that the buyer purchases the item "as-is" as well to secure themselves from any future claims.

How to Make a Bill of Sale in Delaware?

Generally, most Delaware Bills of Sale include:

  • Information about the seller and the buyer. The information provided must clearly identify both parties and include their physical addresses;
  • Description of the sold item. The document must contain all the relevant details necessary for identification of the transferred property: color, size, technical characteristics, serial or registration number, and any other details the parties consider important. This section often contains a list of the item's defects;
  • Price of the sold item. The price is often indicated both in words and in digits;
  • The date of the sale. This part must be included in any bill of sale as it specifies the exact time the item becomes the possession of the new owner;
  • Other details of the transaction. If the sales agreement includes any special conditions, they must be described in this document, too;
  • The signatures of the seller and the buyer.
