A Bill of Sale is needed for private sales and purchases. Generally, this legal instrument is used as proof that the sale really took place. It provides the history of the item and contact information of the buyer and the seller. However, drafting a Gun Bill of Sale is more than just recordkeeping. Additionally, the form shows both parties express mutual consent to the sale and purchase. As a seller or a buyer of the firearm, you can avoid any possible questions that may arise in the future by simply keeping a copy of the document. Without proper documentation, it may be difficult to clear your name, for example, if the firearm has been used to commit a crime.

This document must contain the following information:

1. Seller's full name and mailing address;
2. Buyer's full name and mailing address;
3. Date when the transaction is completed;
4. Location of the sale and purchase;
5. Firearm details. The weapon must be fully described - its caliber, make, model/type, serial number, barrel length, color, accessories, customizations, and other distinctive characteristics that may be used to identify the gun. Additionally, the condition of the item at the time of sale can be added to the form;
6. The agreed-upon price of the firearm and the method of payment (for example, fully paid, initial down payment, or installments). If the transaction is made in cash, the Bill of Sale serves as a protection for the buyer of stolen goods;
7. Warranty. This section explicitly states whether the firearm is being sold "as is" or whether there were additional guarantees given or implied. The "as is" clause means that the seller sells and the buyer purchases the handgun in its present condition, and the buyer accepts the gun with all possible faults and issues, some of which are not immediately visible;
8. Signatures of both parties.
