How to Transfer a Gun in Indiana? {id="mcetoc_1dsp7sjbm0"}
Unlike many other states, Indiana gun laws do not have any severe rules regarding gun transfers. When a seller is not a licensed dealer, neither a background check nor a Bill of Sale is required. However, Indiana prohibits the seller to transfer a firearm to a person under 18. You are also not allowed to transfer a firearm to a person you know or have any reasons to suspect is ineligible to possess a gun, e.g., a person that is a drug or alcohol abuser, is mentally incompetent, or has been convicted of a felony. If you knowingly sell your gun to an individual who is not allowed to own one, it will be considered a Level 5 felony.
That is why if you transfer a firearm to a person you do not know, you are advised to ask a licensed dealer to conduct a background check or at least check if the prospective buyer has a valid permit. You should also prepare a Bill of Sale to document the transfer and keep a copy of the deal.
For a Bill of Sale to protect the legal interests of both the seller and the buyer, it should contain all important details pertinent to the deal. Make sure the document you create contains the following information:
- Identification and contact information of the seller and the buyer. Provide full names, physical addresses, phone numbers, and driver's license numbers. If there are more than one seller or buyer, include them all on the Bill of Sale;
- Detailed description of the firearm: make, model, caliber, serial number, and other details. If the gun you sell has any defects, disclose them to the buyer and list them on the Bill of Sale. If you sell a gun with accessories, list and describe them as well;
- Details of the deal: the date of sale, sales price in words and digits, additional terms of the deal;
- Signatures of all parties involved in the deal.

Indiana State law does not require notarization for a Firearm Bill of Sale, but it is always a good idea to have one especially when selling or buying a gun. This can save any potential trouble which might occur should the seller or buyer contest the transaction at a later date.
