Does Oregon Require a Bill of Sale?
This document is not required by the Oregon laws. At the same time, the seller and the purchaser should fill it out to record the fact of the deal and all essential information on the transfer of various items of value. A properly drafted Bill of Sale is accepted by all government agencies of the state. It will also protect both parties from disagreements or fraudulent claims that may arise in the future. Oregon Bill of Sale Requirements
The legal interests of both the seller and the buyer must be protected by the Bill of Sale, so include the following information in your document:
- Identification information of the parties. Provide their names, full mailing addresses, and phone numbers. You may also add driver's license numbers;
- Description of the item being sold. This identification must identify the item. Enter the model, make, year, size, color, serial and identification numbers, and other useful specifics. If the property comes with accessories or customizations, mention it in writing;
- Payment information. Indicate the price and payment method. If the goods are given as a gift, specify it in this section as well;
- Date and location of the sale;
- Seller's disclosure. The seller must confirm the ownership of the sold item and attest to the fact that this property is free from all encumbrances;
- Buyer's disclaimer. The purchaser must acknowledge all the defects of the item, if there are any, and accept it in its current condition - "as is";
- Additional terms and conditions. The parties are free to negotiate any additional provisions and add them to the document;
- Signatures of both parties.
Does a Bill of Sale have to be Notarized in Oregon?
There is no mandatory legal requirement to notarize an Oregon Generic Bill of Sale, but you may add an extra layer of protection to your document. Prepare the Bill of Sale in two copies, the purchaser retains the original.
