Do You Need a Bill of Sale in Florida?

You are not required to fill out a bill of sale when selling or buying any minor personal property in Florida and the state does not provide you with any government-issued form you can use for this purpose. The bill of sale is useful for the seller and the buyer because it:

  • Serves as material evidence of the item transfer;
  • Can be used as the purchase receipt;
  • Proves that the indicated buyer is now the legal owner of the described item;
  • Releases the seller from the liability for the use of the sold item.

That is why it is traditionally prepared in two original copies and kept with the important documentation by both parties.

To cover all possible issues and to serve as protection for both the buyer and the seller, this document should include:

  1. The identification information about all sellers and co-sellers (their names, driving license or any other ID number, physical address);
  2. The same information about the buyer and all co-buyers;
  3. Description of the sold item, that allows to identify it clearly. Provide the make, model, year, size, color, serial number, and all other applicable information;
  4. If the sold item has any defects, add a section that enlists them;
  5. A clause that provides information about the warranty or states that the buyer takes the goods "as-is". This part will protect both the buyer and the seller form possible fraudulent claims that may arise in the future;
  6. Transaction details. The minimal required information is the price of the sold item and the date of the deal;
  7. Additional information. If you have agreed upon any other terms, carefully describe them in this document as well;
  8. Signatures of the seller and the buyer.
