Does North Dakota Require a Bill of Sale?

The State of North Dakota does not require a Bill of Sale to record the transfer of personal items. However, the seller and the buyer often choose to draft this document to have it as a legal record of their transaction. It is an important document intended to protect the legal interests of both parties. The buyer normally uses the Bill of Sale to prove legal ownership of the purchased item, while the seller is released from any responsibility for the item and its use. The detailed description of all details pertinent to the deal will protect both parties if any problems arise in the future.

Additionally, the terms of the deal, such as the purchase price and the date of the transaction, will allow using the Bill of Sale as a sales receipt. The information stated in writing may be required when either party fills out annual tax forms.

All North Dakota Bills of Sale should contain the following information:

1. Identification and contact information of the parties. At a minimum, indicate their full names and mailing addresses. You may also add their driver's license numbers and phone numbers;
2. Description of the property being sold. It should clearly identify the item, so write down the size, make, model, year, color, serial number, and other details. The seller must disclose defects the property has to the buyer and list them in writing as well;
3. Price of the goods. Indicate the sum of money and the payment method. If the payment is made in several transactions, enter all the dates and the due amounts;
4. Date and location of the sale;
5. Signatures of the parties.
